The custody hearing that transpired on Thursday June 26 did not settle anything in terms of young Sean Preston and Jayden James custody arrangement, so Britney Spears and Kevin Federline are heading to trial.  

"The mediation didn't result in an agreement that would avoid the trial set in August," said loudmouth lawyer Mark Kaplan, in a post-hearing statement. 

It wasn't a breakdown in communication for the parents, however, Kaplan insists, "The mood was comfortable, positive and it was a mood that was consistent with opening at least a great dialogue, which is necessary.
"If the existing arrangement was acceptable to both parties... we wouldn't have to go to trial. But that didn't happen."

Federline's motive seems to be the best interests of the boys: "He wants to have an order," Kaplan said, "that takes into account a certain stability and structure for the kids...regardless of whose house they happen to be at at any given moment."

The trial is set to begin August 25, and should result in a final custody ruling.  Federline is seeking full custody of the boys, after being handed custody during a tramatic hostage situation whereby Spears held her youngest, Jayden James in a bathroom and refused to return the boys to their father after a visitation.
